This Terms of Service governs your use of nexcur.ai, our email subscription, and any preliminary discussions. It does not govern paid engagements; those are governed by the Statement of Work we sign together.
2. Who we are
NexcurAI Inc., a Canadian company. Principal place of business: remote. Contact: hello@nexcur.ai.
3. Acceptable use
You may use the website to read our content, subscribe to our newsletter, contact us about engagements, and reference our published work with attribution. You may not:
- Scrape the site at volume without permission (low-rate, polite reading is fine)
- Attempt to bypass authentication on any non-public endpoint
- Reverse-engineer our template library from published samples
- Republish our writing without attribution and a link back
- Impersonate us in any channel or context
4. Intellectual property
All content on this website - writing, design, code, images, SVGs, brand marks - is © NexcurAI Inc. unless otherwise marked. Our public writing may be quoted (under 300 words) with attribution. Longer excerpts require written permission. Code snippets embedded in public essays are released under MIT unless otherwise marked.
Work product delivered under an engagement is owned by the client per the relevant SOW, subject to a non-exclusive license back to us for internal use, case studies (with consent), and pattern reuse (always anonymized).
5. No warranties on public content
Our published essays, templates, and open-source code are provided as-is. We make reasonable effort to ensure accuracy, but do not warrant that any public content is error-free or fit for any particular purpose. For paid engagements, warranties and service levels are defined in the SOW.
6. Liability
For website visitors: to the maximum extent permitted by law, NexcurAI Inc. is not liable for indirect, incidental, consequential, or punitive damages arising from use of this website.
For engagement clients: liability is capped per the SOW, typically at fees paid in the prior 12 months.
7. AI content disclosure
We tell you openly when content on this website was drafted with Claude assistance. Most essays are so labelled. The template library (Nexmill) is ours; Claude is the generation tool, not the author.
8. Third-party content
Where we cite or link to third-party writing, tools, or data, we credit appropriately. We are not responsible for the accuracy or availability of third-party content.
9. Disputes
These terms are governed by the laws of Canada. Disputes under this Terms of Service go to arbitration under mutually agreed rules. Class action waiver applies.
For engagement disputes, the SOW's dispute resolution clause controls.
10. Changes to these terms
We may update these terms. Material changes are announced 30 days in advance via website banner and email to subscribers. Continued use of the site after the effective date constitutes acceptance. You may also simply stop using the site.
